Following your telephone conversation on 4/10/2006, this letter is to serve as an agreement for an out of court settlement on the above referenced account in the amount of $3,725.82. This amount represents 65% of the balance owed.
To accept this agreement, make one installment in the amount of $3,725.82 due in our office by 4/13/06. Make all payments to Simm Associates, Inc. and send to the mailing address above. Please not that this is your Final installment.
In return, Midland Funding will report your account to your local credit reporting agency as settled and paid “regardless” of your past delinquency history. Any violation of this agreement will result in the full balance of $5,732.06 being due immediately.
Remember, to accept this agreement we must receive your payment by the due date. If for some reason you deviate from these arrangements in any way, the above offer is void.
